Rules used in a draft
What a letter may rely on.
Every ground stays pending legal review. A letter uses a point only where the notice and the dates support it. It does not say the charge is at an end, and it does not predict the outcome.
Protection of Freedoms Act 2012, Schedule 4
- England and Wales only. This does not apply in Scotland or Northern Ireland.
- Paragraph 8 and paragraph 9 are separate. Paragraph 8 is the path where a notice to driver was given. Paragraph 9 is the path where it was not.
- The usual keeper windows are 28 days and 14 days. An ambiguous date blocks the draft.
- A late or incomplete notice is described as a potential keeper-liability defect, not as a cancelled charge.
- Relevant land, mandatory wording, a hire vehicle, and a stolen vehicle are separate tests.
Single Code of Practice
- The joint BPA and IPC code has applied since 1 October 2024. Signage at existing sites has a transition to 31 December 2026. A signage point is used only if the photographs support it.
- The published cap is £100, with an early-payment discount and a grace period. The notice has to be read against the version in force for that site.
- A payment-machine fault is used only where the keeper has a record of the fault. It is not a general ground.
